Riparian zones

 Here's a question that's been bugging me. Supposedly, there's a 30 metre riparian zone to either side of a creek/river. Within that zone, a person is severely restricted regarding what they can do. Now, if the whole area within that 30 m is man-made (tailings), what is the status? Can a person work those tailings without DFO coming down like a tunno bricks on one's head? How 'bout doing recce work on the area? I know a place where it's all tailings (with grass and trees) and filthy with (admittedly fine) gold. Would love to go in there and set up a trommel with a small back-hoe. Thing is, it's mostly within that 30 m. Wouldn't have to worry 'bout muddying up the river 'cause there's plenty of room for a tailing pond and the mater would percolate back and be clear. The only thing needed would be a water-use permit. Anybody? ..Willy.
